RadioFX, Inc. is committed to maintaining your trust as it relates to the privacy of your information. The terms “RadioFX,” “we,” and “us” include RadioFX, Inc. and its affiliates and/or subsidiaries. This Privacy Policy explains how we collect, protect, use, and disclose information we obtain through our technology platforms, including, without limitation, our Mobile Applications, web applications, websites, interactive features, and Twitter and Facebook pages “our platforms.” As used in this Privacy Policy, “Personal Information” means information that alone or when in combination with other information may be used to readily identify, contact, or locate you, such as your name, address, email address, or phone number. We do not consider Personal Information to include information that has been aggregated and/or de-identified so that it does not allow a third party to easily identify a specific individual. 

THE SERVICE COLLECTS YOUR INFORMATION

We collect information, including Personal Information, when you:

·       register an account on the Service;

·       log into the Service with social networking credentials;

·       subscribe to the Service or our newsletter; and

·       communicate with us.

We also collect information, such as anonymous usage statistics, by using cookies, server logs, and other similar technology as you use the Service.

Account Registration. If you register to use the Service, then you must provide us with certain Personal Information, such as your name and email address, in order to create an account and user profile. You also must provide us with certain demographic information, such as your date of birth and gender.

Social Sign-On. We may collect Personal Information from a social media website when you use your social media credentials to log into the Service. For example, when you log in with your Facebook credentials, we may collect the Personal Information you have made publicly available on Facebook, such as your name and profile picture. We may also obtain other non-public information with your permission. Subscriptions. If you obtain a Subscription to the Service, then we will collect your payment information, such as your credit card number, so our service provider(s) can process your payments for the Service. If you subscribe to our newsletter, then we will collect certain Personal Information from you, such as your email address.

Customer Support. We will collect any information, including Personal Information, which you provide to us through your communications with our customer-support team.

Information from Third Parties. We may collect information about you, including Personal Information, from third parties, such as other users who share information about you with us on the Service. For example, we may receive information about you, including Personal Information, when another user allows us to upload your contact information to the Service.

Using the Service. When you use the Service, we collect information about the stations, any content or information that you Post on the Service and any other information resulting from your use of the Service that is publicly accessible by other Users (collectively, “Public Information”).

Your Contacts. If you give us permission to import to the Service the contacts from any email account associated with your account, then we will collect information about your contacts.

Location Information. We may obtain information about your physical location at regular intervals when you use the Service, such as by use of GPS and other geolocation features in the device(s) through which you access the Service, or by inference from other information we collect (for example, your IP address indicates the general geographic region from which you are connecting to the Internet).

Automatic Data Collection. When you use the Service, we automatically collect information about your usage activities. For example, this may include information about the stations, artists or channels you listen to, your views of other Users’ profiles, your searches for friends or stations and your other actions and interactions with other Users or content on the Service.

Cookies and Related Technologies. When you visit the Service, we and our third party service providers receive and record information on our server logs from your browser, including your IP address, and from cookies and similar technology. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Service. Please review your web browser “Help” file to learn the proper way to modify your cookie settings. Please note that if you delete, or choose not to accept, cookies from the Service, you may not be able to utilize the features of the Service to their fullest potential. 

Third parties that advertise goods or services on the Service (collectively, “Advertisers”) may also use cookies to track your use of the Service. We advise you to check the privacy policies of these Advertisers for information about their cookie usage and other privacy practices. Advertisers also may use cookies to track your online activities across websites over time to provide interest-based advertising. One of the third party services that we use to track your activity on the Service is Google Analytics. If you do not want Google Analytics to collect and use information about your use of the Service, then you can install an opt-out in your web browser (https://tools.google.com/dlpage/gaoptout/). You also may opt-out from Google Analytics for Display Advertising or the Google Display Network by using Google’s Ads Settings located at www.google.com/settings/ads.

By using the Service, you are authorizing us to gather, parse, and retain data related to the provision of the Service.

HOW RADIOFX USES YOUR INFORMATION

We use information, including Personal Information, to:

·       facilitate and improve our Service; and

·       communicate with you.      

We may use de-identified and aggregated information for any lawful purpose, including for marketing purposes.

Internal and Service-Related Usage. We use information, including Personal Information, for internal and Service-related purposes, and may provide it to third parties to allow us to operate, provide, maintain and enhance the Service.

Facilitate and Improve the Service. We use information that we collect on the Service, including Personal Information, to facilitate, improve and enhance the Service.

Communications. We may send email to an email address you provide to us (i) for customer-service or technical-support purposes, or (ii) to send you (a) information about topics or content that we think may interest you, or (b) updates about the latest developments or features on the Service. We also may send push notifications and a newsletter to the email address you provide to us in the event that you subscribe to receive the newsletter.

Advertising. Advertising. We may use your information, including Personal Information, to facilitate the delivery of advertisements on the Service.

Aggregate Data. We may de-identify and aggregate information collected through the Service and use it for any lawful purpose, including marketing purposes.

RADIOFX MAY DISCLOSE YOUR INFORMATION

We may share your information, including Personal Information:

·       with our third party service providers;

·       to comply with legal obligations;

·       to protect and defend our rights and property;

·       in connection with a merger, sale or other transfer of our assets; and

·       with your permission.

We do not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission.

Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of the Service.

Legal Obligations. We may access, preserve, and disclose your Personal Information or other account information if we believe doing so is required or appropriate to (i) comply with law enforcement requests and legal process, such as a court order or subpoena; (ii) respond to your requests; or (iii) protect your, our or others’ rights, property, or safety.

Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy or liquidation where the business will not continue as a going concern, receivership, sale of RadioFX assets, or transition of the Service to another provider, then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract. The use of your Personal Information following any of these events should be governed by the provisions of this Privacy Policy in effect at the time the applicable Personal Information was collected.

Consent. We may also disclose your Personal Information with your permission. We may seek your permission in various ways. For example, we may present you with an “opt-in” prompt when you register to use the Servce or access certain Content.

Marketing. We do not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission. If we receive your permission, nonaffiliated companies may use your Personal Information to send you offers or other information that you may find of interest.

Social Networking and Other Websites. The Service may allow you to share information, including Personal Information, with social networking websites, such as Facebook. We do not share your Personal Information with them unless you direct the Service to share it. Their use of the information will be governed by their privacy policies, and you may be able to modify your privacy settings on their websites.

Other Users. Your Public Information will be accessible by other Users. Your profile information, such as any personal photographs, your username and any content that you post in your account, will also be accessible by other Users. We are not responsible for the privacy practices of other Users. Accordingly, we recommend that you carefully consider what you Post to the Service before doing so to guard your anonymity and sensitive information.

Search Engines. Your Public Information may also be accessible through search engines, such as Google or Yahoo, just like with many common social media services.

SECURITY OF YOUR INFORMATION

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional access, use or disclosure.

THIRD PARTY PRIVACY PRACTICES

This Privacy Policy applies only to the Service. The Service may contain links to Third Party Sites. The policies and procedures described in this Privacy Policy do not apply to Third Party Sites. The links from the Service to any Third Party Sites do not imply that we endorse or have reviewed Third Party Sites.

CHILDREN’S PRIVACY

We do not knowingly collect information from children under 13 and we do not want it. We will take steps to delete it if we learn we have collected it.

We do not knowingly collect, maintain, or use Personal Information from children under 13 years of age, and no part of the Service is directed to children under the age of 13. If you learn that your child has provided us with Personal Information without your consent, then you may alert us at support@radiofxinc.com. If we learn that we have collected any Personal Information from children under 13, then we will promptly take steps to delete such information and terminate the child’s account.

INTERNATIONAL USERS

By using the Service, you will transfer data to the United States.

By choosing to visit the Service or otherwise provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the laws of the State of Illinois and the adjudication of any disputes arising in connection with RadioFX or the Service will be in accordance with the Terms of Service located here http://radiofxinc.com/policies/.

If you are visiting the Service from the European Union or other regions with laws governing data collection and use, then please note that you are agreeing to the transfer of your information to the United States and processing globally. By providing your information to the Service, you consent to any transfer and processing in accordance with this Policy.

PRIVACY OPTIONS AND SETTINGS

Account Information. Once you have registered for the Service, you may change your profile settings in your account on the Service. For example, you can change the email address and password associated with your account and you may choose to keep your Follow Lists private.

Opt-out. Each email communication we send you will contain instructions permitting you to “opt-out” of receiving future marketing communications. In addition, if at any time you wish not to receive any future communications or you wish to have your name deleted from our email mailing lists, then please contact us as indicated below. Please note, however, that certain communications, such as push notifications, require you to change the settings on your device if you wish not to receive any future communications. In addition, on occasion we may send service-related announcements, such as disruption notifications, and you may not be able to opt-out of these communications.

REQUESTING DELETION OF YOUR DATA

We provide you with the ability to request deletion of your data.

We store data until it is no longer necessary to provide our services or until your account is deleted - whichever comes first. This is a case-by-case determination that depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational retention needs.

You can request to have your data deleted by:

  1. opening the mobile app,

  2. Signing In (via the Sign In option at the bottom of the 3bar menu, i you are not already signed in),

  3. clicking on the Account Settings menu item on the 3bar menu,

  4. and then clicking on the Delete Account option.

It may take up to 48 business hours for the deletion to be complete. You will no longer be able to sign in as you did before, unless you create a new account. When we delete your account, we delete things you have posted, such as your photos and messages, and you won't be able to recover that information later. 

CHANGES TO OUR PRIVACY POLICY AND PRACTICES

We may revise this Privacy Policy, so please review it periodically.

Posting of Revised Privacy Policy. We will post any adjustments to the Privacy Policy on this web page, and the revised version will be effective when it is posted. If you are concerned about how your information is used, then bookmark this page and read this Privacy Policy periodically. New Uses of Personal Information. From time to time, we may desire to use Personal Information for uses not previously disclosed in our Privacy Policy.

If our practices change regarding previously collected Personal Information in a way that would be materially less restrictive than stated in the version of this Privacy Policy in effect at the time we collected the information, then we will make reasonable efforts to provide notice and obtain consent to any such uses as may be required by law.
